1. Agreement to Terms
By accessing or using the MAXME mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.
MAXME LTD ("MAXME", "we", "us", or "our") reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
2. Description of Service
MAXME is a lifestyle management application that helps users stay organized and achieve their goals. Features may change as we continue to develop the App.
3. Account Registration
3.1 Eligibility
You must be at least 13 years old to use MAXME. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.
3.2 Account Security
You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Acceptable Use
4.1 You Agree NOT To:
- Use the App for any illegal purpose
- Harass, abuse, or threaten other users
- Impersonate another person or entity
- Attempt to gain unauthorized access to the App or its systems
- Use automated scripts, bots, or scrapers
- Interfere with or disrupt the App's functionality
- Upload viruses, malware, or harmful code
5. User Content
5.1 Your Content
You retain ownership of all content you create in MAXME. By using the App, you grant us a limited license to store, display, and transmit your content as necessary to provide the service.
5.2 Content Responsibility
You are solely responsible for your content. We do not monitor, verify, or endorse user content. We may remove content that violates these Terms.
6. Third-Party Links
Important: MAXME may contain links to third-party websites. We are not responsible for the content, products, or services on those websites.
When you click on a link in our App:
- You are redirected to a third-party website
- The third-party's terms of service and privacy policy apply
- We are NOT responsible for your transactions with third parties
- We do NOT process payments or have access to your payment information
7. Intellectual Property
7.1 Our Property
The App, including its design, features, code, graphics, and content (excluding user content), is owned by MAXME LTD and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
7.2 Trademarks
"MAXME" and our logo are trademarks of MAXME LTD. Third-party brand names and logos belong to their respective owners.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including but not limited to:
- Merchantability and fitness for a particular purpose
- Accuracy, reliability, or completeness of content
- Uninterrupted, secure, or error-free operation
- Results obtained from using the App
We do not warrant that:
- The App will meet your requirements
- Your data will never be lost (please maintain your own backups)
- The App will be available at all times
- Defects will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXME LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
We are not liable for:
- Loss of data, profits, or business opportunities
- Personal injury or property damage
- Unauthorized access to your account
- Errors, mistakes, or inaccuracies in the App
- Third-party services
- Service interruptions or downtime
In any case, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless MAXME LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your content posted in the App
- Your violation of any third-party rights
11. Termination
11.1 By You
You may stop using the App and delete your account at any time through Settings → Account → Delete Account.
11.2 By Us
We may suspend or terminate your account if you violate these Terms or engage in harmful activity. Upon termination, your right to use the App ceases immediately.
12. Changes to Service
We reserve the right to modify, suspend, or discontinue any feature at any time without notice. We will not be liable for any modification, suspension, or discontinuation of the App.
13. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Tel Aviv-Jaffa, Israel.
14. Dispute Resolution
Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at contact@maxmeltd.com. We will try to resolve your concern within 30 days.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MAXME LTD regarding the App.
